What Is USVisaPrep.NET?

USVisaPrep.NET is the visa interview pre-examination service offered by former U. S. visa officer and AV rated immigration attorney Jose E. Latour. The purpose of USVisaPrep.NET is to establish an affordable and reliable method of ascertaining potential visa interview problems BEFORE the visa applicant travels abroad for the visa interview. USVisaPrep.NET is simply a mechanism through which an individual en route to apply for a U.S. visa abroad may pass his or her documentation before the eyes of a seasoned visa veteran to ensure that no fundamental elements, documents, or ineligibilities exist before they travel abroad.
 

How Much Does USVisaPrep.NET Service Cost?

We offer two USVisaPrep.NET service options: a standard 7 day option which is $300 and a 24 hour service which is $500. Based upon Mr. Latour’s extensive travel and the fact that he may not have online access at time, the 24 hour visa option is, on occasion, not available. Clients are therefore strongly discouraged  from waiting till the last days before departing the U.S. or appearing at the consulate abroad.

Time is measured rom the time that your visa documentation is received by USVisaPrep.NET either by fax or by e-mail attachment.  Mr. Latour will respond with his written evaluation within 24 hours or 7 days, depending on the service option selected.  In the event a client selects the 24 hour service option and Mr. Latour is unable to conduct the evaluation within that timeframe, USVisaPrep.NET will convert the $500.00 24 hour USVisaPrep.NET service into a 7 day $300.00 service, and the client will be refunded the $200.00 difference within one business day.  PLEASE NOTE: since Mr. Latour will do his best to conduct any such evaluation ASAP, it is not possible to receive a full refund; clients filing for a $500 24 hour evaluation will automatically be converted to standard $300, 7 day evaluations, without notification.  Accordingly, if you want an overnight evaluation ONLY, please do NOT initiate Paypal payment without first emailing This e-mail address is being protected from spambots. The best way to proceed is to plan your visa interview with enough time so you can both save $200.00 and be sure that you will have the USVisaPrep.NET response before you travel. While the last minute service exists because sometimes there is no alternative, preparation is key in securing Visa approval and we much prefer to make our fees $300.00 at a time, as opposed to $500.00!

 

If I already have an immigration attorney, why would I want to use USVisaPrep.NET?

Jose Latour is a former U. S. visa officer who has worked exclusively in the field of business immigration and international representation since 1990. When Jose first started representing individuals in visa processing, he traveled on a monthly basis to foreign countries, physically accompanying clients. The process was expensive, but in over 300 foreign consular representations, all clients were approved. Jose points out that this is not a result of any particular infallibility on his part but, rather, on his ability to ascertain the deniability of a visa BEFORE leaving the United States for the interview.

USVisaPrep.NET is not for everyone. If you have a routine visa case – whether represented by an immigration attorney or without legal representation – you may be comfortable proceeding to the interview without fear of denial. For example, a western European student visa applicant with ample ties to his or her country and who has been accepted by a leading U. S. university would probably not benefit from USVisaPrep.NETsince he or she will be eligible for the visa in most cases.

On the other hand, some cases are more complex, and the review performed by the trained eye of a former visa adjudicator may be worthwhile. For example, in marriage visa cases, although the underlying marriage may be perfectly valid, the documentation submitted to the Consul will often time make or break the initial approval. Absolutely! Most of the people who use USVisaPrep.NET are, in fact, not represented by an attorney. While complex visa filings generally require the involvement of an experienced immigration attorney, many routine visa applications – student visas, healthcare worker H1-B visas, and marriage based visas are often handled by the individual applicant, without counsel. We can certainly help those folks but it is necessary for the prospective visa applicant to remember that USVisaPrep.NETdoes not substitute for legal representation at the pre-petition or petition phase of the visa process; it is simply a document review and eligibility evaluation service which takes advantage of Jose Latour's particular legal expertise.
 

Am I Permitted to Prepare in Advance for my Visa Interview?

The decision on whether or not to seek assistance in preparing for one's visa interview is entirely up to each individual applicant.  Contrary to popular belief, preparation for your visa interview is not only permissible under U.S. law, but, in reality, essential. What IS prohibited by law is "coaching", that is, when the visa applicant is given specific instructions on what to say to the Consular Officer at the time of interview.  Such a practice is not only deceptive, but oftentimes complicates an otherwise approvable visa by confusing the issues.  Our visa evaluation service does not purport to give specific interview instructions to a visa applicant.  USVisaPrep.NET is simply a pre-interview evaluation service which considers the various elements required for visa approval in a given category and provides the prospective visa applicant with the information he or she needs to ensure proper preparation for the visa interview.
 

Will a USVisaPrep.NET Review Tell Me What to Say at the Consulate?

USVisaPrep.NET IS NOT A COACHING SERVICE!   As a former Fraud Officer in Mexico, Mr. Latour knows very well that the underlying legitimacy of the visa application process requires an honest communication and exchange of information between the examining visa officer and the visa applicant. USVisaPrep.NETsimply assists a visa applicant in making sure that there are no fundamental ineligibilities, documentary deficiencies, or other tell-tale issues which could result in a visa denial.

Consider this example: A "routine" H1-B visa applicant, a physical therapist, is en route to Manila for a restamp of her visa. In filling out the visa application, the individual has notes a minor issue which occurred in college: a "driving while intoxicated" arrest which resulted in no conviction.  This is where things get tricky: Even a relatively minor arrest can result in visa denial. In this hypothetical example, if the individual had completed the USVisaPrep.NETintake questionnaire, Jose Latour would have identified this issue, saving the individual in question several thousand dollars in airfare, and permitting her to have a Filipino attorney resolve the minor matter BEFORE she returns to Manila for visa issuance.

 

What is Consular Processing?

Consular processing is the issuance of a visa for a qualified immigrant or non-immigrant by a U.S. visa officer stationed abroad. Consular processing is the ordinary method through which a visa is issued to a foreign national seeking to enter the United States. The process applies for tourist visas, student visas, business visas, and a variety of permanent residency categories.

"Adjustment of status" means that an individual is qualified to obtain a new visa category – immigrant or non-immigrant – without leaving the United States. The rules are complex but, essentially, an individual who has entered into the United States lawfully in a visa category which permits transition to a new visa category may be able to do so through the U.S. Customs and Immigration Service (USCIS) regional office closest to their place of residence.

 

I'm Confused...I already have an approval from the USCIS...Do I need to go back to my home country for a visa?

Chances are that if you are asking this question, you do need to go home. Most people who are in the United States and have received an approval for a new visa category, be it nonimmigrant or immigrant, will have concurrently filed for "adjustment of status" in the United States. If you did not do so, or if your attorney did not do so, it most likely means that you need to go home for your visa interview.  Similarly, if for whatever reason you have a non-immigrant approval which is not a "change of status", you need to go home and get a fresh visa issued in the proper category.  One more thing: REMEMBER that while the visa is what gets you in the U.S., the I-94 issued at the airport -- or by the USCIS on an I-797 if you've extended nonimmigrant status -- are what determines how LONG you can REMAIN in the U.S.

How do I know if I am eligible for a U.S. Visa?

A U.S. Consular Officer may deny a visa for a variety of reasons. First and foremost, there is what is known as the "presumption of immigrant intent". Under Section 214(b) of the U.S. Immigration and Nationality Act, an individual is effectively "guilty until proven innocent" when they apply for a temporary visa into the United States.

What does this mean? A LOT when it comes to tourist or business visitor visas (B1/B2).  Since the United States is a highly desirable country in which many individuals seek to live and work, an applicant for a tourist or business visa into the United States must establish to the satisfaction of the visa officer that he or she is in such a situation in their native country that they are not likely to violate U.S. visa rules and remain unlawfully in the United States beyond the period of authorized stay. Elements which are considered by the visa officer in determining whether or not this standard has been met include employment history, family ties, economic situation, and (unfortunately) the migratory reality of the home country of the applicant. For example, individuals who are from countries with a high rate of immigration (such as Mexico, India, the Philippines, etc.) will have a more difficult time meeting this standard than an individual from a country which traditionally does not have many of its nationals remain in the United States unlawfully.

For those who have an approved family or employment based visas, other factors can lead to denial, even IF you already have the I-797 approved.  Mr. Latour designed the USVisaPrep.NET questionnaire to explore the various issues which can lead to visa denial.

 

What can I do if my visa was denied?

Unlike many other U.S. federal decision makers, a U. S. Consular Officer's denial of a visa cannot be overturned by any appellate process. While many attorneys aggressively will attempt to convince a Consul that she or he has erred in denying a particular visa, tact and clarity is the best approach. Most visa denials result from two fundamental issues:

  1. Fundamental ineligibility for the particular visa sought and
  2. Unclear or missing qualifying information which would help the visa officer make a favorable decision.

When you send your visa supporting documentation to USVisaPrep.NET, our job is to review the documents in light of the circumstances behind the case, the visa category, your nationality, and everything we know regarding visa adjudication processes in the particular country in which you are applying. While we cannot guarantee the issuance of a visa, our objective is to give you as accurate as possible an assessment of what the odds for approval will be.

In the event your visa is denied, you have several choices:

  1. You can seek to clarity the issue with the visa officer (if he or she is willing to give you a second interview; many jurisdictions do not permit reapplication for a visa for a number of months, although this is prohibited by regulation.)
  2. You can hire an attorney or other qualified individual to help you determine the issues which resulted in the denial and what can be done to overcome them.

The bottom line is this: It is far easier to avoid a visa denial by NOT GOING TO AN INTERVIEW WHERE DENIAL IS IMMINENT THAN IT IS TO OVERCOME THE DENIAL. It is easier and safer to make whatever corrections you can before the FIRST interview, thereby removing the onerous burden of convincing a Consular Officer to overturn his/her or another Consular Officer's visa denial.
